Bombay High Court Questions Liquor Ban in Pune

In a recent legal challenge, the Bombay High Court scrutinized the Maharashtra government’s imposition of a 12-day liquor ban in Pune, coinciding with the Ganeshotsav celebrations. The court posed critical questions about the lack of consistency and rationale behind targeting only Pune for such a prohibition.

The controversy arose when the state, led by a coalition of the Bharatiya Janata Party, Shiv Sena, and Nationalist Congress Party, enforced a liquor ban in Pune, arguing it would prevent potential disturbances during the festival. However, the court found the logic behind this decision to be questionable, emphasizing that the consumption of alcohol does not inherently lead to disorderly conduct.

Health Risks and Logical Basis

The court highlighted potential health implications for habitual drinkers deprived of alcohol, with Chief Justice Mahesh Chandra Tripathi voicing concerns about possible medical issues that could ensue. He suggested that such restrictions might inadvertently lead to an increased burden on medical facilities.

In his remarks, Justice Tripathi pointed out that festivals bring joy, stating that people should be allowed to enjoy them. He challenged the state by asking, “Why only Pune?” questioning whether the ban’s selective enforcement was sending an undesirable message about the city.

Government Response Sought

The bench comprising Chief Justice Tripathi and Justice Advait Sethna demanded that the state government justify its decision, asking for a detailed explanation later in the day. This scrutiny indicates the court’s expectation for a solid justification for implementing such significant restrictions.

The case against the blanket ban represents a broader inquiry into the balance between public safety and personal freedoms, especially during cultural and religious events. While maintaining order during festivities is important, the need for justifiable and non-discriminatory measures remains paramount.
