Indian Fertility Clinics and Sperm Banks Under New Regulatory Directive

New Delhi: In a significant move aimed at enhancing patient safety, the Central Drugs Standard Control Organisation (CDSCO) has mandated that only registered fertility clinics and sperm banks can procure essential laboratory materials used in in-vitro fertilization (IVF) procedures. This directive follows concerns over unregistered facilities being supplied with critical products that may compromise patient health and welfare.

The CDSCO’s circular explicitly states that substances such as IVF media, cryopreservation media, reagents, and other consumables employed in assisted reproductive techniques will only be made available to centers that have undergone registration as stipulated by the Assisted Reproductive Technology (ART) and Surrogacy Acts.

IVF media consists of specialized solutions designed to manage, preserve, and cultivate eggs, sperm, and embryos throughout the fertility treatment process. Under the Medical Devices Rules, 2017, these products are classified as medical devices, necessitating licenses for either manufacture or import.

Regulatory Framework and Compliance

The Assisted Reproductive Technology (Regulation) Act, 2021, along with the Surrogacy (Regulation) Act, 2021, regulates ART clinics and sperm banks to foster safe and ethical reproductive healthcare practices. This regulatory framework aims to minimize risks associated with unregulated medical practices.

In an effort to enforce this regulation, the CDSCO has called upon all stakeholders—including state and Union Territory licensing authorities, manufacturers, and importers—to ensure compliance with the new guidelines. The circular has been disseminated widely to ensure that IVF media, cryopreservation media, and related consumables are exclusively supplied to duly registered clinics and banks.

“This directive serves the greater public interest by ensuring that only compliant facilities are involved in the sensitive field of assisted reproductive technology,” a CDSCO official stated.

By restricting the availability of vital laboratory materials to registered facilities, the CDSCO aims to uphold the integrity of reproductive healthcare and guard against practices that could jeopardize patient wellbeing.
