Civil Service Pension Delays Could Lead to Tax Penalties for Bereaved Families

Bereaved families in the UK may soon find themselves saddled with unexpected tax charges, all due to significant delays in the settlement of civil service pension claims. Recent warnings to the government highlight this potential issue, with Conservative MP Sir Geoffrey Clifton-Brown describing it as ‘unjust’ for these families to face such burdens, especially when the delays are beyond their control.

HMRC Tax Rules Under Scrutiny

According to current regulations by HMRC, certain lump sum benefits from pensions must be distributed within two years of notifying the pension scheme about the death, to avoid taxation. However, ongoing delays have thwarted this from occurring in a timely manner for many, including the families of former civil servants dependent on the prompt disbursal of benefits.

These delays are primarily attributed to the administrative takeover by Capita, an outsourcing company, which inherited more than 86,000 unresolved cases and has since grown this backlog to 120,000, despite a planned transition period. This has left many waiting for essential funds, adding financial uncertainty to their bereavement.

Efforts to Address the Issue

Addressing these delays, the Cabinet Office has stated that there are compensation routes through the Pensions Ombudsman, though this could take 18 months or longer to resolve, compounding existing frustrations. The PCS union, representing civil servants, has voiced concerns about the time it takes to resolve these pension cases.

For people like Rob Wassell, who has been waiting nearly two years for his late brother’s pension payout, the slow process adds to the stress of grieving. He, along with others, risks having to pay tax on benefits not received promptly, exacerbating financial strain.

Urgency for Government Intervention

Sir Geoffrey Clifton-Brown has reached out directly to Cabinet Office Minister Louise Haigh, urging for government intervention to prevent what he sees as an inevitable imposition of financial penalties on these families. The push for changes comes as the Pensions ombudsman struggles with a slew of complaints, indicating the broader inefficiencies within the scheme.

Frances O’Grady of the PCS union has characterized the situation as a ‘profound injustice’, emphasizing the pressing need for the government to act swiftly. Without immediate intervention, families already facing emotional and financial hardships may have to endure further through a taxing administrative system.
