Bank of America Faces $1.2 Billion Fine for Anti-Money Laundering Failures

Bank of America Penalized for Compliance Shortcomings

In a significant regulatory action, Bank of America has been ordered to pay a staggering $1.2 billion fine due to shortcomings in detecting and reporting potential money laundering activities. This fine, levied by the US Treasury Department, underscores the gravity of the bank’s compliance failures, which involved over $5 billion in suspicious transactions going unreported. A portion of this amount, $1 billion, is particularly concerning as it poses risks linked to national security and illicit financing.

Regulatory Oversight and Violations

The breach included the failure to identify transactions connected to international money laundering networks, such as those associated with China, and trade-based schemes with links to areas near the southwestern US border. As a result, the Treasury Department has expressed significant concern about the consequences such failures pose to the broader U.S. financial ecosystem. These concerns were echoed by Treasury Secretary Scott Bessent, who highlighted the dangers of inadequate anti-money laundering and sanctions compliance, particularly for an institution of Bank of America’s size.

Bank’s Response and Financial Implications

Reacting to these developments, Bank of America has acknowledged its need for remedial actions and has pledged to enhance its regulatory compliance practices. The bank has confirmed that this fine will be reflected in its forthcoming quarterly earnings report, impacting earnings per share by 17 cents. The financial giant is reportedly dedicating significant resources and personnel to rectify the highlighted issues, tying these efforts into their existing operational costs.

Breaking Down the Settlement

This financial penalty, one of the largest ever imposed by the Treasury, also includes fines from the Office of the Comptroller of the Currency (OCC) and the Office of Foreign Assets Control (OFAC). The OCC alone has levied a $750 million fine, marking it as its largest penalty to date. Meanwhile, OFAC has linked part of its settlement to breaches involving 475 sanctions violations, spanning areas like Russia, Iran, narcotics, and terrorism.

Consequences and Commitments

A significant point in the Treasury’s findings was the bank’s excessive dependency on external parties like law enforcement to flag suspicious activities instead of relying on its own internal protocols. As part of the settlement, Bank of America has conceded to willfully breaching the Bank Secrecy Act by not adhering to necessary anti-money laundering controls, owing to inadequate due diligence and improperly handling foreign correspondent accounts.

The revelations from this case strongly underline the importance of stringent internal controls and proactive reporting mechanisms to safeguard the global financial system against significant risks posed by illicit financial flows.
